Beta Testing Terms and Conditions

1. Purpose

These Terms and Conditions govern your participation in EC-Council’s beta testing activity (“Purpose”).

2. Confidential Information

All information disclosed to you by EC-Council in connection with the Purpose, whether before or after acceptance of these Terms and Conditions, and whether in written, oral, or electronic form, shall be deemed Confidential Information.

Confidential Information includes, but is not limited to, EC-Council courseware, exam items, questions, answers, methodologies, content, standards, calculations, notes, materials, manuals, documents, memoranda, analyses, forecasts, and test or exam papers (“Exam Materials”).

3. Use and Protection of Confidential Information

You agree that you shall:

  • Use EC-Council Confidential Information solely for the Purpose;
  • Not disclose, reproduce, distribute, publish, transmit, or disseminate Confidential Information in any form or medium without EC-Council’s prior written consent;
  • Not translate, store, record, or share Confidential Information in any language or format unless expressly authorized by EC-Council.

4. Prohibited Conduct

You shall not:

  • Create, publish, distribute, or participate in exam dumps or any unauthorized materials containing EC-Council Confidential Information;
  • Copy, photograph, record, transcribe, or otherwise reproduce any EC-Council exam questions, answers, or related materials, in whole or in part;
  • Engage in any activity that compromises the integrity, confidentiality, impartiality, or security of EC-Council examinations.

5. Intellectual Property Rights

All Confidential Information remains the exclusive property of EC-Council and is protected under applicable intellectual property laws, including copyright, trademark, patent, design, and other proprietary rights.

Nothing in these Terms and Conditions shall be construed as granting you any ownership, license, or other rights in EC-Council’s Confidential Information, except where expressly agreed in writing by EC-Council.

6. Non-Transferability

Your participation and any rights or obligations under these Terms and Conditions are personal to you and may not be assigned, transferred, or delegated without EC-Council’s prior written consent.

7. Conflict of Interest Declaration

You confirm that you are not:

  • A Certified EC-Council Instructor; or
  • A member of any EC-Council board, committee, or group that may result in a conflict of interest with the Purpose.

8. Future Instructor Eligibility

You acknowledge that if you seek to become a Certified EC-Council Instructor, you may apply only after one (1) year has elapsed from the expiration or termination of your participation under these Terms and Conditions, subject to EC-Council’s prior written consent.

9. Accuracy of Information

You represent that all information provided by you to EC-Council is true, complete, and accurate. Any false or misleading information shall constitute a breach and may result in immediate termination of participation without liability to EC-Council.

10. Return or Destruction of Confidential Information

Upon EC-Council’s request or instruction, you agree to promptly return or permanently destroy all Confidential Information and any copies thereof, including notes, memoranda, analyses, and materials prepared for the Purpose.

11. Indemnification

You agree to indemnify, defend, and hold harmless EC-Council, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to your breach of these Terms and Conditions.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore, excluding conflict of laws principles. You irrevocably submit to the exclusive jurisdiction of the courts of Singapore.

13. Acceptance

By clicking “I Agree”, you acknowledge your acceptance of these Terms and Conditions and your obligation to protect EC-Council’s Confidential Information.
